Access to port facilities and onboard passengers returning from excursions - Clarifications.

1. Scopo
Fornire ai Comandi territoriali gli opportuni chiarimenti in relazione all’argomento - già comunicati ad Assiterminal ed alla Capitaneria di porto di Napoli in sede di risposta a quesito - per l’opportuna ed omogenea applicazione delle norme di Maritime security a livello locale.
Provide the Italian Coast Guard local Offices with the appropriate clarifications in relation to the topic - already communicated to Assiterminal and the Port Authority of Naples when responding to a question - for the appropriate and homogeneous application of Maritime security regulations at the local level.

2. Premessa
È pervenuto a questo Comando generale un quesito da parte di Assiterminal relativo alla possibilità di riconoscere come validi - ai fini dell’accesso agli impianti portuali e a bordo dei passeggeri di rientro da escursione - i tesserini rilasciati dalla nave recanti dati del passeggero e relativa foto.
A question has been received by the Italian Coast Guard Headquarters from Assiterminal regarding the possibility of recognizing as valid - for the purposes of access to the port facilities and onboard passengers returning from excursions - the badges issued by the ship containing passenger data and photo.
Al riguardo il “Programma Nazionale di Sicurezza Marittima contro eventuali azioni illecite intenzionali” (edizione 2021) Rev. 1 - approvato con D.M. 287 del 20.09.2022 - prevede che:
> per i passeggeri in imbarco, siano esibiti e verificati il titolo di viaggio e un idoneo documento di riconoscimento (parte IV § 4.1.g - § 10.2 - § 10.3);
> per i passeggeri già imbarcati, in caso di discesa a terra e di ritorno a bordo, l’accesso all’impianto portuale ed a bordo della nave è consentito purché gli stessi siano compresi nell’elenco passeggeri, fornito dall’agente marittimo (parte IV § 4.1.h.), senza un espresso richiamo all’esibizione di un documento di identità.
In this regard, the "National Maritime Security Program against possible intentional illicit actions" (2021 edition) Rev. 1 - approved with Ministerial Decree No. 287 of 20th September 2022 - provides that:
> for boarding passengers, the travel document and a suitable identification document are shown and verified (part IV § 4.1.g - § 10.2 - § 10.3);
> for passengers already on board, in the event of excursion/other and return on board, access to the port facility and on board the ship is permitted if they are included in the passenger list, provided by the maritime agent (part IV § 4.1.h.), without an express request to show an identity document.
Preso atto che il PNSM distingue fra i passeggeri che imbarcano per inizio crociera e quelli che, già imbarcati, rientrano a bordo dopo la discesa a terra per escursione/altro, resta, tuttavia, ovvio e necessario che il confronto tra il passeggero e il nominativo di cui all’elenco passeggeri (es. copia cartacea, computer, tablet) - da effettuarsi necessariamente in fase di rientro - garantisca la certezza della identità dello stesso.
Having acknowledged that the PNSM distinguishes between passengers who embark for the start of the cruise and those who, having already embarked, return on board after going ashore for an excursion/other, it remains, however, obvious and necessary that the cross check between the passenger and the name referred to in the passenger list (e.g. paper copy, computer, tablet) - to be carried out necessarily during the return phase - guarantees the certainty of the identity of the passenger.

3. Disposizioni
Per quanto sopra - ai soli fini di security e necessario cross check come di seguito meglio specificato - si ritiene comunque necessario che l’identità di tutti i passeggeri in rientro a bordo venga accertata tramite esibizione di un documento di identità ovvero altro tesserino, anche rilasciato dalla nave, purché recante il nominativo del passeggero e la foto, o con altro sistema elettronico equivalente (es. braccialetto), al fine di scongiurare possibili sostituzioni di persona.
For the above - for the sole purpose of security and necessary cross check as better specified below - it is nevertheless considered necessary that the identity of all passengers returning on board is ascertained by showing an identity document or other card, even issued from the ship, as long as it bears the passenger's name and photo, or with another equivalent electronic system (e.g. bracelet), in order to avoid possible substitutions of people.
Quanto sopra ferme restando le normative unionali e nazionali in merito ai documenti necessari all’attraversamento delle frontiere ed a quelle in materia di circolazione in Italia di cittadini stranieri
Per maggiore chiarezza apposito emendamento al pertinente paragrafo del PNSM sarà proposto, per l’approvazione, al Comitato Interministeriale alla prima revisione utile del testo del Programma.
The above is without prejudice to the EU and national regulations regarding the documents necessary for crossing borders and those regarding the movement of foreign citizens in Italy.
For greater clarity, a specific amendment to the relevant paragraph of the PNSM will be proposed for approval to the Inter-ministerial Committee at the first useful revision of the text of the Programme.
Tenuto conto, infine, di alcune difficoltà avanzate da associazioni di categoria delle port facilities, circa la possibilità, per alcuni impianti, di disporre di adeguati software per la gestione ed il controllo delle liste dei passeggeri in transito (es. computer, tablet), si ritiene che l’esibizione del tesserino rilasciato dalla nave purché contenga foto e riferimento alla crociera in atto (es. No. Identificativo della crociera o periodo temporale di inizio e fine crociera) possa essere considerato accettabile per l’accesso all’impianto portuale, in analogia a quanto previsto dalla parte IV § 4.1.g del PNSM.
Inoltre, nel caso in cui il tesserino:
1) sia privo di riferimento alla crociera, dovrà essere accompagnato da copia del titolo di viaggio; ovvero
2) contenga i riferimenti della crociera ma sia privo di foto, dovrà essere accompagnato da un valido documento di identità (Carta d’identità o Passaporto).
Finally, taking into account some difficulties raised by the port facilities trade associations regarding the possibility, for some facilities, of having adequate software for the management and control of the lists of passengers in transit (e.g. computers, tablets), it is believed that the presentation of the card issued by the ship as long as it contains photos and reference to the cruise in progress (e.g. Number of the cruise identifier or time period of start and end of cruise) can be considered acceptable for access to the port facility, in analogy to the provisions of part IV § 4.1.g of the PNSM.
Furthermore, in the event that the card:
1) has no reference to the cruise, must be accompanied by a copy of the travel document; that is to say
2) contains the cruise details but does not have a photo, must be accompanied by a valid identity document (identity card or passport).
Tutto quanto precede in via temporanea e comunque fino al 1° giugno 2024.
All of the foregoing on a temporary basis and in any case until 1 June 2024.
Si riporta in allegato, per correntezza, uno schema riepilogativo delle sopraccitate disposizioni.
For the sake of accuracy, a summary of the aforementioned provisions is attached.
Restano salvi i controlli di sicurezza, sulla persona e sul bagaglio, che andranno effettuati secondo le percentuali previste dalla parte IV - sezione B - tabella A del PNSM.
The security checks on the person and on the baggage remain unaffected, which must be carried out according to the percentages provided for in part IV - section B - table A of the PNSM.
Si precisa infine, come chiarito dal competente Ministero dell’Interno, che le attività di controllo dei citati “titoli di accesso” (documenti d’identità, tesserini nave, ecc.), rientrano nei servizi di sicurezza sussidiaria ex art. 2, comma 2, lett. i), del D.M. 154/2009 e sono ascrivibili alla competenza esclusiva delle guardie particolari giurate.
Finally, it is specified, as clarified by the competent Ministry of the Interior, that the control activities of the aforementioned "access documents" (identity documents, ship badges, etc.) fall within the subsidiary security services pursuant to art. 2, paragraph 2, letter. i), of the Ministerial Decree 154/2009 and are attributable to the exclusive competence of private security guards.

4. Conclusioni
La presente Circolare è pubblicata sul sito istituzionale del Corpo delle Capitanerie di porto - Guardia Costiera alla sezione “Sicurezza della Navigazione”¹ a fini di pubblicità legale ai sensi dell’articolo 32 della legge n. 69/2009 e, esclusivamente, inviata alle parti interessate cui compete la puntuale implementazione delle misure ivi indirizzate.
